All images within this website are the exclusive property of Patrick Clarke and are protected by UK and International Copyright Laws.

1.) Definitions

Photographer means the commissioned photographer, Patrick Clarke, or other as agreed with the commissioning client.

Basic Editing includes the removal of dust spots, exposure optimisation, colour balance for indoor shots and the addition of a blue sky for exterior shots when required (not all clients require blue sky).

Where it is not physically possible/permissible to move items that are not desired in the final image; it may be possible to remove the items in post production upon client request and an additional charge of £65/hour will be levied for this.

Cancellation within two hours of the start time of an appointment will incur a fee of £20 Monday-Friday appointment times between 9am-5pm and a fee of £40 for a night shoot or weekend work. If an appointment is cancelled with greater notice than two hours, no fee will be charged.

A night shoot is a job that starts at or after 6pm regardless of the season.

Weekend work is work carried out on a Saturday or Sunday.

Half day shoot will last no longer than four hours on location and may not take as long as four hours.

Full day shoot will last no longer than ten hours on location and may not take as long as ten hours.

2.) Payments

Payment of invoice must be achieved within 30 days of the date of issue. The photographer reserves the right to charge interest on late payments at the rate prescribed by the Late Payment of Commercial Debts (Interest) Act 1998 from the date payment was due until the date payment is made.

3.) Acceptance & Delivery

Following completion of the shoot the Photographer will deliver the agreed images to the client before 24 hours have elapsed, with the exception of a night shoot or full day shoot where additional time will be agreed to complete the editing of images. Images will be delivered electronically using an agreed file sharing platform and it is the duty of the commissioning client to inform the Photographer of any preference regarding file type and size. If no preference is expressed, high resolution TIFF files will be supplied.

4.) Copyright & Usage

Entire copyright and all similar rights remain with the Photographer at all times. The commissioning client has rights to use purchased images electronically or in print and a photographer credit should be used where appropriate. Images may not be distributed, sold nor shared with any third party without the written permission of the Photographer. It is possible for the Photographer to be commissioned by multiple bodies, Shared Commission, and this must be agreed prior to the shoot.
